One thing worth knowing: this is the federal picture, and a specific employer or fleet can still set its own internal testing policy as a condition of the job, so if you are told you must test, it may be a company rule rather than a government one. Either way, the certification decision itself stays with your medical examiner.

Can you get or keep a CDL with sleep apnea?

Yes. A sleep apnea diagnosis does not automatically disqualify you. If you are effectively treated and your treatment is documented, you keep your CDL, with the medical examiner making the final certification call. The disqualifying situation is untreated sleep apnea severe enough to make you unsafe, not the diagnosis itself. One practical note many drivers miss: keep your treatment going even between physicals, because a gap in documented use is what actually puts a renewal at risk, not the original diagnosis.

A test with chain of custody is tamper-proof in any practical sense and defensible if reviewed, so your examiner can accept it the first time. Some cheap mail-order tests get questioned precisely because they cannot prove this.

Examiners order a sleep test when risk factors stack up, commonly a BMI of 35 or higher, a large neck circumference, loud habitual snoring, witnessed pauses in breathing, daytime sleepiness, high blood pressure on multiple medications, type 2 diabetes, or a history of falling asleep driving. It is not personal and not an accusation. It means your profile fits a pattern worth confirming, and a test gives you and your examiner a real answer instead of a guess.

It is fast. You pick up the device in person at my Downey office, sleep with it for two nights at home, and return it. What if my test comes back positive for sleep apnea?

A positive result is a starting point, not the end of your career. We treat it, with CPAP or an oral appliance, document the treatment for your examiner, and you keep driving, typically on a one-year medical certificate that you renew annually. Many drivers feel dramatically better once treated, with their daytime alertness back. The diagnosis is the turn you take to get around the wall, not the wall itself.

What is the CPAP compliance rule for CDL drivers?

If you are treated with CPAP, your examiner wants to see real usage, and the common benchmark is roughly 70% adherence, meaning at least four hours of use per night on at least 70% of nights over a recent period of about a month. Your CPAP machine records this automatically and produces a compliance report. Bring that report to your physical, because the number on it is what turns your one-year certificate into a renewal.

I cannot tolerate CPAP. Is there an alternative that still keeps me compliant?

Yes. Treated drivers are usually issued a one-year medical certificate rather than the standard two years, so you recertify annually. Each year you bring current proof your treatment is working, either a fresh CPAP compliance report or a documented oral appliance follow-up.
